Richard’s practice has focused on all aspects of insurance law, including general liability, errors and omissions, and directors and omissions coverage. He has dealt with extensive and complex coverage disputes, through litigation and negotiations in a variety of jurisdictions, which involved contractual and extra-contractual liabilities. In addition, Richard has provided insurers with advice on coverage issues presented by claims, and assisted with effective assertion of their defenses. He is experienced in the management of “books” of claims, as both coverage and monitoring counsel. These include large-scale insurance agent, registered representative and broker/dealer E&O programs. He is thus well-versed in legal trends effecting the insurance and securities industry. Richard is also experienced with the defense of tort litigations, including premises liability, employment and professional liability cases. His malpractice defense work has involved lawyers, accountants and life insurance agents. In addition, Richard has drafted many types of professional liability policies, and frequently provides insurers with advice on the wording of manuscript insurance contracts.


Insurance Law
Richard is adept at and has vast experience with all aspects of insurance law, particularly, but without limitation, professional liability (including D&O), general liability and EPL coverage. He has written thousands of coverage opinions during his career. He has also defended insurers in a variety of coverage litigations in various jurisdictions. Issues raised by those actions range from the interpretation of policies to alleged bad faith.

Claims Management
Richard has served as coverage and monitoring counsel for books of literally thousands of professional liability claims. In this capacity, he has developed claims handling procedures that are in compliance with all regulations and best practices for insurers. Richard’s also been involved with all aspects of claims, including initial coverage reviews, issuance of coverage position letters, evaluation of potential exposure and provision of reserve recommendations.

Using his experience in insurance law, Richards has provided assistance in drafting professional liability policies which properly express carrier’s intent. In addition, he has drafted related materials, including applications and underwriting guidelines.

Professional Liability Defense
Richard has defended lawsuits against professionals such as insurance brokers and agents, lawyers and directors/officers. His goal is to undertake quick and effective evaluations of actions, and to achieve the most effective means of resolution, including the use of dispositive motions.
